Please read these Terms of Service ("Terms") carefully before using Archive Sale ("we", "us", "our", "the site"). By accessing or using the site, you agree to be bound by these Terms. If you don't agree, please don't use the site.

Who we are

Archive Sale is an Australian discovery platform that lists past-season and discounted fashion sales from third-party brands ("Brands"). We help you find sales — we do not sell products, process payments, hold inventory, or ship anything ourselves.

What Archive Sale is (and isn't)

• Archive Sale is a discovery and referral platform. When you click "Shop Sale" or a brand link, you leave our site and transact directly with the Brand, on that Brand's own terms and conditions.
• We are not a retailer, reseller, or agent of any Brand featured on the site, unless explicitly stated.
• Where a Brand is marked as a "Partner" on the site, this means we have an affiliate/commission relationship with them — we may earn a commission if you make a purchase after clicking through. This does not make us the seller of that Brand's goods, and it does not change the Brand's own terms applying to your purchase.
• Brands not marked as a partner are listed independently, for your convenience, and are not affiliated with, sponsored by, or endorsed by Archive Sale, nor do we have any commercial relationship with them.

Accuracy of sale information

We make reasonable efforts to keep sale details (discount percentages, dates, "ends soon" labels, and similar) accurate and up to date, based on information published by Brands. However:

• Sale terms, pricing, availability, and end dates are set and controlled entirely by the Brand, and can change without notice.
• We do not guarantee that any sale, discount, or offer displayed on Archive Sale is currently accurate, available, or honoured by the Brand.
• Always confirm current pricing and sale terms on the Brand's own site before purchasing.

Accounts and favourites

If you create an account, you're responsible for keeping your login details secure and for all activity under your account. You can request deletion of your account at any time (see our Privacy Policy for how).

Brand names, logos, and images

• Brand names and logos displayed on Archive Sale are used to identify and refer to the relevant Brand and its sales, and remain the property of their respective owners.
• Use of a Brand's name or logo on Archive Sale does not imply sponsorship, partnership, or endorsement by that Brand unless explicitly marked as a "Partner" on the relevant listing.
• Imagery used alongside listings is either licensed for our use, independently sourced, or created for illustrative/editorial purposes only, and is not intended to represent official Brand photography unless stated.

Brand takedown requests

If you are a Brand (or an authorised representative of one) and want a listing, logo, image, or reference to your brand removed or corrected, contact us at [insert email] with:

• The specific listing/page in question
• What you'd like changed or removed
• Confirmation of your authority to make the request on the Brand's behalf

We aim to review and action legitimate requests promptly.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose
• Attempt to scrape, copy, or republish our content at scale without permission
• Interfere with the site's operation or security
• Misrepresent your identity or affiliation when contacting us or creating an account

Limitation of liability

To the maximum extent permitted by law:

• Archive Sale is provided "as is", without warranties of any kind regarding accuracy, availability, or fitness for purpose.
• We are not liable for any loss or damage arising from your reliance on sale information displayed on the site, or from your dealings with any Brand, including issues with orders, payments, delivery, refunds, or product quality — those are matters between you and the Brand.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Intellectual property

All content on Archive Sale that isn't Brand-owned (our design, text, original photography, and site functionality) belongs to us or our licensors and may not be copied or reused without permission.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Continued use of the site after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
